Terms and Conditions (UK)

1) About us

A. Dawes T/A Prime EPC Midlands ("we", "us") provide domestic Energy Performance Certificate (EPC), Floor Plan, And Thermal Imaging services in England & Wales.

2) How these terms work

  • These Terms govern your use of our website and, where you purchase services, your contract with us.

  • Our Scheduling Terms (appointment windows, cancellations/reschedules, access, waiting, fees) form part of these Terms and apply to every EPC booking.

  • Our Privacy Policy and Cookies Notice explain how we process personal data and use cookies.

  • If these Terms conflict with the Scheduling Terms, the Scheduling Terms take priority for anything relating to appointment management.

3) Who may use the site

You must be 18+ (or have authority from a business owner/landlord/agent) to place a booking. You may use the site only for lawful purposes.

4) Information we give you before you buy

We display clear pricing and key information about the service before checkout, including: what is included, VAT status, any mandatory charges (e.g., parking/ULEZ at cost), the 24‑hour policy and your statutory cancellation rights. You will see and accept the Terms before placing a booking.

5) Quotes, orders & contract formation

  • A quote is an invitation to purchase, not an offer. Your order is accepted when we send a Booking/Appointment Confirmation.

  • We may refuse an order/appointment/booking (e.g., out of area, safety issues, payment not received). If payment was taken and we cannot accept the order, we’ll refund you promptly.

  • We may cancel an order/appointment/booking (e.g. an emergency). You will receive a full refund in this event.

6) Prices, taxes & transparency

  • Prices shown are always inclusive of VAT (if any), and in GBP.

  • We don’t use “drip pricing”: any mandatory fees are shown up‑front; optional add‑ons are clearly marked as optional.

  • If parking/ULEZ or pre‑agreed mileage applies, we disclose this before you confirm.

7) Paying us

Unless otherwise agreed, payment is due on booking. We accept: all major credit cards and debit cards Via Stripe or ServiceM8 pay.

8) Scheduling & cancellations (summary)

  • Free changes: cancel or reschedule (OVER) ≥24 hours before your booking time— no fee.

  • Late reschedule UNDER 24 hrs (<24h): 25% Of the Total Costs.

  • Late cancellation UNDER 24 hrs (<24h): 25% Of the Total Costs.

  • No access / failed attendance (we attend but cannot proceed): up to 100% of the booking total to cover travel and lost time.

  • Waiting beyond 15 minutes at your request: £10 per additional 15 minutes.
    These charges are designed to be reasonable and proportionate to our direct costs.

9) Consumer cooling‑off (distance/off‑premises bookings)

If you’re a consumer booking online/phone/off‑premises, you have a 14‑day cooling‑off right to cancel. If you ask us to attend within 14 days, you consent to early performance and acknowledge that once the appointment is fully performed the cooling‑off right ends; if you cancel after we’ve begun, you’ll pay a proportionate amount for work already done (e.g., admin/scheduling time and any travel/parking already incurred).
Business customers and bookings made on our premises do not have this cooling‑off right.

10) What a visit involves

An EPC related visit:

The visit is visual and non‑destructive. It is not a building survey, safety test, or guarantee of condition. Ratings depend on observed features and evidence provided at/after the visit. (See Privacy Policy for access and evidence handling.)

A floor plan related visit:

The visit is visual and non‑destructive. It is not a building survey, safety test, or guarantee of condition. Measurements are taken internally and the plan is produced on site in the 2nd dimension (orthographic top down) and for illustrative viewing only. (See Privacy Policy for access and evidence handling.)

A thermal imaging related visit:

The visit is visual and non‑destructive. It is not a building survey, safety test, or guarantee of condition. It is purely qualitative and observational. Observations are photographed using thermal imaging photography and reports are produced off-site and in accordance with BS EN ISO 6781-1:2023. (See Privacy Policy for access and evidence handling.)

11) Acceptable use of our site

Do not misuse the site (e.g., attempt unauthorised access; upload malware; scrape at scale; or use automated bots that disrupt normal use). We may suspend or block access if we detect abuse and report to the relevant authorities.

12) Intellectual property

All website content (text, graphics, logos, images, software) is our property or used under licence. You may view, print and share links for personal/business use connected with arranging EPCs. You must not copy, modify, or commercially exploit site content without our permission.

13) Reviews and user content

If you submit reviews or feedback: (a) you grant us a non‑exclusive licence to use them on our site and marketing; (b) you warrant they are genuine and lawful; (c) we may moderate or remove content we reasonably consider misleading, unlawful or abusive. We do not solicit or permit fake reviews.

14) Third‑party links

Links to third‑party websites/tools are provided for convenience; we are not responsible for their content or policies. Use them at your own discretion.

15) Privacy & cookies

We follow UK GDPR and the Data Protection Act 2018. See our Privacy Policy for details of what we collect, why, and your rights. Key scheduling data are limited to contact details and appointment data.

16) Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited by law.
For other losses: (a) if you are a consumer, we are responsible for loss caused by our failure to use reasonable care and skill; (b) if you are a business, our total liability arising from these Terms is limited to the price paid for the relevant booking, and we exclude liability for indirect or consequential loss, loss of profit, or loss of business, in each case only to the extent permitted by law.

17) Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control (e.g., severe weather, illness, accidents, network outages). We will contact you to rebook or refund services not provided, based on your discretion.

18) Complaints

Tell us within 14 days of any issue and we’ll investigate promptly. If you remain dissatisfied, you may escalate to our accreditation body (details appear on your EPC certificate) or seek advice from Citizens Advice/Trading Standards.

19) Changes to these Terms

We may update these Terms from time to time. The version shown at checkout applies to your booking. Material changes will be highlighted on this page.

20) Governing law & jurisdiction

These Terms are governed by the laws of England and Wales and disputes are subject to the exclusive jurisdiction of its courts.
